Title of the assignment : Support to Secretariat of the Staff Appeals Committee (SNAC)
Brief description of the Assignment : The main objective of this assignment is to provide additional support the Secretariat of SNAC in the delivery of its work program, especially in view of an increasing workload in the number of Appeals requiring timely resolution by aggrieved staff including separating and active staff members. .

TERMS OF REFERENCE
SUPPORT TO SNAC SECRETARIAT
- BACKGROUND :
Established in 1964, the African Development Bank is the premier pan-African development institution, promoting economic growth and social progress across the continent. There are 80 member states, including 54 in Africa (Regional Member Countries). The Bank’s development agenda is delivering the financial and technical support for transformative interventions that will significantly reduce poverty through inclusive and sustainable economic growth. In addition to providing finance, the Bank is Africa’s voice on global economic, financial and development issues, a role that has taken significant importance considering increasing global integration and interconnected risks.
The Staff Appeals Committee is part of the Bank’s internal recourse mechanism with a specific task of ensuring fairness in dealing with various staff grievances especially those relating to their contracts of employment and terms of appointment. These include disputes relating to employment benefits, career development, performance evaluations, probation management, termination, and non-renewal of employment contracts among other things. The Staff Appeals Committee complements the work of both informal and the only formal and binding recourse mechanism, the Administrative Tribunal.
- OBJECTIVE OF ASSIGNMENT :
The main objective of this assignment is to provide urgent support to the Secretariat of SNAC in the delivery of its work program, especially as regards the review of submissions to ensure they comply with statute, organization of appeal sittings, analysis of evidence, facts and documents, reporting on results of the arbitration process, providing advice and guidance on Rules, Regulations and practice and procedure to achieve the timely resolution of employment disputes.
- SCOPE OF SERVICES :
Under the direct supervision and guidance of the Secretary to the Staff Appeals Committee and the Chairperson of the Committee, the Consultant shall support the SNAC Secretariat Office as follows :
- Conduct a review and/ or appraisal of new and ongoing appeals by ensuring compliance with the Bank’s Staff Regulations, Rules and the Committee’s Rules of Procedure ;
- Review written exchanges to ensure internal consistency with the existing Staff Rules and Rules of Procedure of SNAC and provide guidance and advise to parties or their legal counsel on processes and procedure of SNAC ;
- Prepare under the supervision of the Secretary of SNAC meetings of the Committee, including Preliminary Meetings to deal with issues about the Committee’s jurisdictional competence, admissibility and disclosure requests ;
- Conduct research into the jurisprudence and decisions of the Bank’s Administrative Tribunal, law of the international civil service and internal laws of the Bank ;
- Carry out legal analysis, review documents, and draft summary notes consistent with the internal justice system of the Bank and international best practice ;
- Prepare technical reports and briefing notes for the Chair and Members of the Committee ;
- Follow-up of institutional commitments by ensuring and reminding stakeholders of timeliness ;
- Participate in the execution of special assignments like inductions; and
- Undertake other assignments as may be requested by the Secretary or the Chairperson.
- DELIVERABLES :
Reports and briefing notes related to the above tasks. A monthly report on activities and assignments carried out during the period. A final report at the end of the assignment on activities conducted, pending cases and their statuses.
- ACCOUNTABILITY & REPORTING :
The Consultant will be housed in the SNAC Secretariat Office and will report to the Secretary to the Staff Appeals Committee and when necessary, to the Chairperson or the Alternate Chairperson.
- DURATION :
The assignment shall preferably start in April 2021, for a period of one year, renewable once and subject to satisfactory performance.
- ELIGIBILITY :
- Be a national of one of the member countries of the Bank Group
- Possession of a Certificate of Legal Practice in good standing in a Member Country
- At least a master’s degree (or its equivalent) in international law, administrative law or specialized Knowledge of Institutional and employment law
- Minimum of five years of relevant experience especially in Registry work in International Tribunals.
- Excellent drafting, analytical and editing skills
- Ability to work both independently, with minimum supervision and with teams
- Good organizational skills with ability to prioritize and deliver assignments in a timely manner
- Good analytical skills with ability to quickly review documents and prepare briefing notes highlighting key issues with ability to explain complex legal issues to non-lawyers
- Ability to apply innovative approaches, work independently and apply new methods to solve problems
- Good interpersonal and communication skills
- Knowledge of internal justice processes of international institutions would be an advantage
- Competent in the use of Bank standard software (Word, Excel, Access, PowerPoint, and web tools)
- Fluent in French or English, with preferably a working knowledge of the other language
- REMUNERATION :
The remuneration will be an all-inclusive fee to be negotiated upon contract signature, and in compliance with the Bank’s established remuneration scale considering requisite qualifications and experience.
