- Title of the Assignment : Development of Electricity Regulatory Index for Africa (ERI) 2021 ;
- Brief Description of the Assignment : The Energy Financial Solutions, Policy and Regulation Department (PESR) of the Power, Energy, Climate Change and Green Growth Complex (PEVP) wishes to contract two individual power sector regulation consultants (one each of French and English-speaking expert) to assist the Bank’s team to develop the 2021 edition of the Electricity Regulatory Index for Africa (ERI). This assignment will involve desktop research into regulatory frameworks of African Countries, review of previous editions of the ERI, administration of survey questionnaire, data collection, analysis of survey results, calculation of the index and writing of ERI report covering up to forty-five African Countries. The consultants will also prepare Country Regulatory Notes for each participating based on the survey responses. Detailed TOR is attached in Annex 2.
- The Department Issuing the Request : This request originates from the Energy Financial Solutions, Policy and Regulation Department (PESR) within the Power, Energy, Climate and Green Growth Sector Complex (PEVP) of the African Development Bank. The PESR department provides support to the Bank’s Regional Member Countries, and African sub-regions in the establishment of relevant energy policies and clear, predictable and transparent regulation frameworks to ensure financial sustainability of the sector and attract private investments for the development of energy projects in Africa that will facilitate the universal access to electricity in Africa as envisaged in the Bank’s “Light up and Power Africa” priority area (High 5).

- Duration of Contract : Six (6) Months
- Tentative Date of Commencement: December 2020
- Eligibility and Selection Criteria :
Interested Consultants shall provide information on their qualifications and experience demonstrating their ability to undertake the Assignment (relevant documents, information on similar services undertaken in the past, relevant experience, etc.). The eligibility criteria, the establishment of a short list and the selection procedure shall be in conformity with the Bank’s Rules and Procedures for the Selection of Individual Consultants. Please, note that interest expressed by a Consultant does not imply any obligation on the part of the Bank to include him/her in the shortlist. The Bank reserves the right to cancel or post-pone this REOI process.
A shortlist of three to six individual consultants will be established at the end of the request for expressions of interest. The consultants on the shortlist will be evaluated on the following criteria on the basis of their profiles.

ANNEX 2: TERMS OF REFERENCE
Electricity Regulatory Index for Africa (ERI) 2021
- BACKGROUND :
1.1. The Power, Energy, Climate Change and Green Growth Sector Complex (PEVP) of the African Development Bank (the AfDB or the “Bank”) has the purpose to fulfil the objectives of “Light Up and Power Africa”. This includes the objective of achieving universal access to energy by 2025 across Africa. One of the critical drivers to enable this goal will be to strengthen energy policy, regulation and sector governance across Africa. This involves supporting and providing leadership in the establishment of appropriate energy policies and clear, predictable and transparent regulatory frameworks to ensure financial sustainability of the sector and mobilize private investments.
1.2. The Bank’s Policy, Regulation & Statistics Division of the Energy Financial Solutions, Policy and Regulation department is primarily tasked with the provision of leadership in the establishment of relevant energy policies and clear, predictable and transparent regulation framework to ensure financial sustainability of the sector and mobilize private investments for the development of energy projects in Africa.
1.3. The AFDB through the Energy Policy, Regulation & Statistics Division has developed the Electricity Regulatory Index for Africa (ERI) as part of a series of knowledge products covering issues relating to the development of effective and investor-friendly regulatory frameworks overseeing the electricity sectors in African countries. The ERI is a composite index that measures the level of development of the electricity sector regulatory frameworks of African countries against international standards and best practice.
- OBJECTIVE :
2.1. The Bank is seeking the services of two (2) Power Sector Regulatory Consultant (s) to develop the 2021 edition of the Electricity Regulatory Index (ERI) for Africa and accompanying Regulatory Country Notes.
- SCOPE OF WORK :
The Consultants is are expected to undertake the following tasks to support the delivery of the Electricity Regulatory Index for Africa (ERI) :
- Review the 2018 , 2019 and 2020 ERI report (s) and make recommendations to the Bank for improving the Report for its 2021 edition;
- Review the existing methodology for the ERI 2020 propose any new relevant methodology for the Bank’s review and proposed mathematical and statistical models to be used ;
- Review the existing survey questionnaires, determine and agree the scoring methodology with ;
- The Bank’s ERI team and assign appropriate scores and weightings to the survey questionnaires, as deemed necessary ;
- Administer the questionnaires, collect the data and undertake the necessary calculations to construct the Index (and sub-indexes) ;
- Undertake desktop research on the regulatory framework of participating countries analyze and verify the outcomes of the surveys and data collected to empirically assess the performance of the regulatory environment of participating countries based on the selected key indicators ;
- Formulate technical recommendations for decision-makers in participating countries and to the Bank for the improvement of the performance of the regulatory framework of their power sector ;
- Develop Regulatory Country Notes for each participating country in the ERI 2021, summarizing the results of each country on ERI; identifying critical gaps and providing recommendations ;
- Draft the 2021 edition of the Electricity Regulatory Index report for Africa for review and validation by the Bank and produce the final report incorporating the Bank’s comments ;
- Update the existing database with the new data obtained in the study ;
- Provide technical support (papers, issue notes, presentations, etc.) when required in group meetings, inception and validation workshops and launching;
- DELIVERABLES :
The key deliverables of this assignment are :
- Electricity Regulatory Index (ERI) report for Africa 2021 ;
- Country Regulatory Notes for all participating countries ;
- Detailed Methodology Report for the 2021 edition of the ERI, including discussion on score allocations, weighting and computations ;
- Updated ERI database of participating countries.
- DURATION AND LOCATION OF THE ASSIGNMENT :
- The assignment will be for 6 months. An extension could be considered subject to performance and availability of funds ;
- The commencement date is expected to by December 2020 ;
- The Consultant will be based at the Bank’s headquarters in Abidjan, Cote d’Ivoire and requires regular full-time presence in the Bank’s offices. Field missions will be required.
- QUALIFICATIONS :
The candidate shall meet the following minimum requirements :
- Citizenship of a member country of the AfDB (regional or non-regional) ;
- A Master’s degree in Energy and/or Economics, Regulations, Policy or related field ;
- Have a maximum of 10 years of relevant professional and senior experience in power regulation analysis, energy sector reforms and policy ;
- Demonstrated knowledge (in French speaking countries for the French speaking Consultant and in English speaking countries for the English speaking Consultant) of the African energy context, including established networks and analytical publications on the subject matter ;
- Multidisciplinary skills essential to develop a sector wide analysis from technical to economic and financial aspects of power sector regulation and reforms ;
- Excellent quantitative and qualitative research and analysis skills ;
- Proven ability to write comprehensive reports and other relevant documentation under time pressure ;
- Evidence of previous published reports and publications preferably on regulation and policy ;
- Excellent written and verbal communication skills in English or French with working knowledge of the other ;
- Demonstrated strong technical and analytical skills; dynamism; results-orientation; and problem-solving capability.
- REMUNERATION :
Remuneration will be based on the Consultant’s experience and the Bank’s Guidelines on Individual Consultants Remuneration.
